How does that work exactly with the legal reflection period when purchasing a home? We will explain it to you. When does the reflection period start? First of all, it is important to know when the reflection period starts. From what moment should you start counting? The thing is: you have verbal agreement with the real estate agent about the price and conditions for the purchase of your home. After this, the realtor will draw up the deed of sale (the purchase contract). The purchase deed is signed by you as the buyer and must of course also be signed by the seller. The reflection period starts from the day after the signed purchase deed has been handed over to you. This means: that you have received the purchase deed signed by the seller / selling realtor back. Just an example: You sign the deed of sale on Wednesday the 10th of October. The seller is not present at the signing and will not sign the purchase deed until Thursday the 11th of October. You will receive the deed of purchase back on Friday the 12th of October. The reflection period will then start on the 13th of October. So 1 day after the purchase deed has been ‘handed to you’. The NVM sales deeds are provided with a confirmation of receipt on which the buyer writes the date of receipt with his signature underneath. When does the reflection period end? A lot of people makes the mistake here. Many people think that the reflection period takes 3 days. Wrong! The reflection period takes at least 3 days. The General Terms and Conditions Act applies to the cooling-off period and actually says the following:

  • If the reflection period ends on a Saturday, Sunday or generally recognized public holiday, it will be extended up to and including the next working day.
  • The reflection period must include at least 2 working days.

With working day we mean here any day that is not a Saturday, Sunday or a generally recognized public holiday. What does the statutory reflection period look like now? We have worked it out for you below. We put in a normal week and the week of Christmas (December 25 and 26). Good luck with the math!
